Acceptable Use Policy

What may and may not be run on our network.

Applies to: All services, including reseller accounts and their end customers.

1. Purpose

This policy protects our customers, our network and third parties. It applies to every service, including reseller accounts, whose holders are responsible for their own customers' compliance.

2. Prohibited content and activity

The following are prohibited without exception:

  • Child sexual abuse material. Reports are escalated immediately and referred to the authorities.
  • Phishing, credential harvesting, and fraudulent or deceptive commerce.
  • Distribution of malware, exploit kits, or command-and-control infrastructure.
  • Unsolicited bulk email, and hosting sites advertised through it.
  • Unauthorised access attempts, port scanning or denial-of-service activity directed at any system. In Singapore this is also an offence under the Computer Misuse Act 1993, and equivalent offences exist in every country we operate in.
  • Infringement of copyright, trademark or other intellectual property rights.
  • Content unlawful under the law applicable to you or to the hosting location.

3. Content lawful in one country and not another

We host in Nepal, Australia, India, Singapore, Canada, the United States, France, Germany, Italy, Poland and the United Kingdom. Content that is lawful where you live may be unlawful where your server sits, and we are subject to the law of the country the server is in.

Where content is lawful in your country but not in your hosting region, the practical answer is usually to move the service to a region where it is lawful, and we will help you do that rather than simply suspending you. Where no such region exists on our network, we cannot host it.

This is a question of where the servers are, not a judgement about your content. We will always tell you which law we are applying and why.

4. Resource use

Shared platforms are shared. Activity that materially degrades service for other customers may be limited or suspended, and we will contact you and propose a suitable plan wherever the situation allows it.

  • Sustained resource use beyond your plan limits, after notice.
  • Using shared hosting primarily for file storage, backup archiving or media distribution unrelated to a hosted site.
  • Cryptocurrency mining, and public proxy or VPN exit nodes on shared platforms.

5. Email and marketing messages

Bulk or marketing email must be sent through a dedicated bulk platform, not through hosting or mail hosting accounts. Recipients must have opted in, and unsubscribe requests must be honoured promptly.

You are responsible for complying with the marketing law that applies to your recipients, not just to you. The rules differ significantly, and the strictest one in your list governs your send:

6. A note on Canadian recipients

CASL is the strictest regime on this list and the one customers most often get wrong. It requires express or clearly implied consent before a commercial electronic message is sent, it puts the burden of proving consent on the sender, and it applies to messages sent to a Canadian recipient regardless of where you are. An opt-out list built for CAN-SPAM will not satisfy it.

7. Enforcement

We investigate reports and, where circumstances allow, contact the customer with a deadline to act. Immediate suspension is reserved for cases where waiting would cause harm.

Repeated or serious breaches may result in termination without refund.
