Draft, pending professional review
This document is a working draft prepared for review by a qualified legal adviser. It is not legal advice, and it is not the final agreement. Highlighted passages mark positions that must be settled before publication.
Placeholder, pending verification: REFUND WINDOW — TO BE CONFIRMED PER ENTITY AND PER JURISDICTION, INCLUDING ANY MANDATORY CONSUMER RIGHTS THAT OVERRIDE IT
Where a money-back period applies, it runs from the date of the first invoice for a new service and applies to the service fee only.
This policy is our commercial offer. It sits on top of your statutory rights and never replaces them. Where the two differ, the law wins, and you do not need to argue the point with us.
| Where you are | What you are entitled to regardless of this policy |
|---|---|
| Nepal | Consumer Protection Act, 2075 (2018) |
| Australia | Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). The consumer guarantees in Part 3-2 cannot be excluded, restricted or modified by contract (s 64). |
| New Zealand | Consumer Guarantees Act 1993 and Fair Trading Act 1986. The Consumer Guarantees Act may only be contracted out of where the customer acquires the service for the purposes of a business (s 43). |
| Singapore | Consumer Protection (Fair Trading) Act 2003 |
| Canada | Provincial and territorial consumer protection legislation |
| France | Code de la consommation, implementing Directive 2011/83/EU, including the fourteen-day right of withdrawal and the digital-services exception at article L221-28 |
| United States | the FTC Act and state consumer protection statutes |
If you are a consumer in France or elsewhere in the EU, you normally have fourteen days to withdraw from a distance contract without giving a reason.
For a digital service there is an important exception. If you ask us to begin providing the service within the fourteen days, and you acknowledge at that point that you will lose the right of withdrawal once performance has begun, the right ends when we start. This is the exception at article L221-28 of the Code de la consommation, implementing Directive 2011/83/EU.
We ask for that acknowledgement explicitly at checkout rather than burying it, because a customer who wants their hosting live immediately and a customer who wants to keep a cooling-off period are making different choices, and both are reasonable. If you do not give it, we wait out the fourteen days before provisioning.
The following are excluded because we incur an unrecoverable third-party cost. This exclusion does not displace a statutory right under section 2:
Refunds are issued by the entity that issued the invoice, to the original payment method, in the original currency. Where currency conversion applies, the amount you receive may differ from the amount charged because of exchange rate movement and your bank's fees.
Services terminated for breach of the Acceptable Use Policy are not refunded, except where a statutory right requires otherwise.
Open a billing ticket from the client area. We aim to process approved refunds within [REFUND PROCESSING TIME], and your bank may take longer to show it.
